Brobot ONE Terms of Service and Agreement
This Brobot ONE Service Agreement (“Agreement”) is entered into between The Brobot LLC, a Florida limited liability company (“Brobot,” “we,” or “us”), and the individual or business entity that accepts it online (“Subscriber,” “you,” or “your”). This Agreement governs your access to and use of Brobot ONE services and is effective on the date and time you accept it at checkout.
1. Services
Brobot ONE is a cloud-based business communications and CRM platform operated by The Brobot LLC and powered by GoHighLevel infrastructure. Services are provided under three tiers:
Brobot ONE Voice: Includes VoIP phone service, call recording, and contact management.
Brobot ONE Connect: Includes everything in Voice plus two-way SMS/MMS messaging and full CRM automation features.
Brobot ONE Growth: Includes everything in Connect plus advanced CRM workflows, pipeline management, reputation management, and reporting.
Monthly subscription prices depend on your tier and the number of lines you order. The prices below are the total monthly amounts you pay for the subscription, including the 4% payment processing fee:
| Lines | Voice | Connect | Growth |
|---|---|---|---|
| 1 | $152/mo | $172/mo | $345/mo |
| 2 | $168/mo | $208/mo | $382/mo |
| 3 | $183/mo | $244/mo | $420/mo |
| 4 | $199/mo | $280/mo | $457/mo |
| 5 | $214/mo | $317/mo | $491/mo |
| 6 | $230/mo | $353/mo | $528/mo |
| 7 | $246/mo | $389/mo | $565/mo |
| 8 | $260/mo | $426/mo | $601/mo |
| 9 | $275/mo | $462/mo | $638/mo |
| 10 | $291/mo | $499/mo | $674/mo |
Each “line” corresponds to one provisioned phone number and device slot. The number of lines equals the number of physical desk phone devices deployed to your office. Lines are not additive across tiers; upgrading from Voice to Connect or Growth replaces your pricing with the higher tier’s rate for your number of lines.
2. Billing and Payment
Subscription fees are billed monthly in advance. Your first monthly charge is made 10 days after you place your order. This 10-day period is a setup window for number transfers and getting your system started, during which you are not billed the monthly subscription. Any phone hardware upgrades you select are charged at checkout. All prices shown include a 4% payment processing fee. Fees are non-refundable except as required by applicable law.
Payment is due at the start of each billing cycle. Failure to pay within 10 days of the due date may result in service suspension. Accounts suspended for non-payment that are not brought current within 30 days may be subject to termination and early termination fees where applicable.
All fees are in U.S. dollars. Brobot reserves the right to update pricing with 30 days written notice to the subscriber.
3. Fair Use Policy
Brobot ONE subscriptions include unlimited calling and texting subject to the following fair use thresholds per provisioned line per calendar month:
- Voice: 1000 minutes of inbound or outbound calling per line
- SMS/MMS: 1,500 message segments per line (Connect and Growth tiers only)
These thresholds reflect normal business use for office environments. Accounts that consistently exceed these thresholds may be reviewed, and Brobot reserves the right to contact the subscriber to discuss usage patterns or adjust service terms accordingly. Brobot does not bill per-minute or per-message for usage below these thresholds.
Usage that suggests automated dialing, robocalling, lead-blasting, or any use inconsistent with normal business communication is prohibited regardless of volume and may result in immediate service suspension.
4. AI Usage and Billing
Certain Brobot ONE plans include access to AI-powered features such as Voice AI, Conversation AI, Reviews AI, and related tools (collectively, “AI Features”). AI Features consume computing resources billed by our underlying platform provider on a usage basis.
4.1 AI Usage Fees
AI Feature usage is billed separately from your monthly subscription and line fees. Charges are calculated based on your actual consumption, including but not limited to AI agent minutes, conversation responses, review replies, and token usage, multiplied by Brobot’s then-current AI billing rates. Current AI billing rates are visible at any time inside your client portal.
4.2 Rates Subject to Change
Because AI infrastructure costs are set by third-party providers and may change over time, Brobot does not guarantee fixed per-unit AI rates for the duration of your contract. Your monthly subscription fee is fixed for your contract term; AI usage charges are variable based on consumption and prevailing rates. Brobot will provide reasonable notice of material rate changes.
4.3 AI Usage Wallet
AI usage charges are drawn from a prepaid wallet funded by your payment method on file. You are responsible for maintaining a sufficient wallet balance. Service interruptions due to an insufficient wallet balance do not constitute a service failure by Brobot and do not affect your obligations under this Agreement.
4.4 No Included AI Allowance
Unless explicitly stated in your plan description at the time of purchase, no AI Feature usage is included in your monthly subscription. All AI usage is billed on a pay-per-use basis at the rates described above.
5. Equipment
24-Month Contract – Included Equipment: Subscribers who agree to a 24-month service term receive Grandstream desk phone hardware at no additional charge. The number of devices provisioned corresponds to the number of lines on the account. Equipment remains the property of The Brobot LLC during the service term. Upon cancellation prior to the end of the term, devices must be returned in working condition or the subscriber will be responsible for the replacement cost of unreturned or damaged equipment.
Device Purchase Option: Subscribers who prefer not to enter a 24-month commitment may purchase their equipment outright. In this case, no minimum service term applies and the subscriber may cancel with 30 days written notice.
Equipment is provisioned and configured by Brobot. Subscribers agree not to modify, re-flash, or remove device configurations without prior authorization.
6. Service Term and Cancellation
24-Month Contract: The standard service agreement is a 24-month term beginning on the date of your first monthly charge (10 days after your order). During this term, the subscriber’s monthly rate is locked and will not increase.
Early Termination: If a subscriber on a 24-month contract cancels before the end of the term, an early termination fee equal to 50% of the remaining monthly subscription fees for the balance of the term will apply. Equipment must also be returned as described in Section 5.
No-Contract Option: Subscribers who purchase their own equipment outright are not subject to a minimum term. Service may be cancelled with 30 days written notice. No early termination fee applies.
How to Cancel: Cancellation requests must be submitted in writing to [email protected]. Verbal cancellations are not accepted. Service continues until the end of the final billing cycle for which payment has been made.
7. Regulatory Compliance
A2P 10DLC Registration: All subscribers on Connect or Growth tiers (and any Agent Broski AI Growth tier) who send SMS/MMS messages are required to complete A2P 10DLC brand and campaign registration as required by U.S. carrier regulations. All A2P-related fees, including one-time brand and campaign registration fees and any ongoing monthly carrier fees associated with active A2P campaigns, are the responsibility of the subscriber and will be passed through to the subscriber at cost with no markup. These fees are set by The Campaign Registry and U.S. carriers and are subject to change without notice. Brobot will assist with the registration process but cannot guarantee approval timelines or outcomes, as these are determined by The Campaign Registry and the underlying carriers.
Texting services will not be activated until A2P registration is confirmed. To complete registration, subscribers must have an active business website with a compliant opt-in form, privacy policy page, and terms of service page. If these assets are not in place, Brobot can assist with their creation as a separate billable service.
Number Porting: Subscribers may port existing business phone numbers to Brobot ONE. Number porting is a standard business-to-business transfer governed by FCC regulations. Brobot will initiate the porting process upon receipt of a completed Letter of Authorization (LOA) and a recent copy of the subscriber’s phone bill from the current carrier. Porting timelines vary by carrier and are not guaranteed. Existing service with the losing carrier remains the subscriber’s responsibility until porting is confirmed complete.
Nature of Service: Brobot ONE is a software platform that integrates CRM, workflow automation, and communication tools. The Brobot LLC is not a telecommunications carrier, VoIP provider, or licensed telephone company. Voice and SMS capabilities are provided through third-party infrastructure operators (including GoHighLevel and Twilio) who hold applicable carrier relationships. Brobot acts solely as a software reseller and platform integrator.
Subscriber Responsibilities: Subscribers agree to use Brobot ONE services in compliance with all applicable federal, state, and local laws governing their use of automated communications tools, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and applicable state telemarketing regulations. Compliance with these laws is solely the subscriber’s responsibility. The Brobot LLC assumes no liability for a subscriber’s failure to comply with applicable communications laws.
8. Limitation of Liability and Disclaimers
Brobot ONE services are provided “as is.” The Brobot LLC makes no warranties, express or implied, regarding uptime, call quality, SMS deliverability, or fitness for a particular purpose. Service is dependent on third-party infrastructure including GoHighLevel, Twilio, and Grandstream, and Brobot is not liable for outages, degradations, or failures caused by those providers.
In no event shall The Brobot LLC be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the service, including but not limited to lost revenue, missed calls, or failed message delivery. Brobot’s total liability to any subscriber for any claim shall not exceed the total subscription fees paid by that subscriber in the 90 days preceding the claim.
9. Modifications to Service and Terms
Brobot reserves the right to modify these Terms of Service at any time. Subscribers will be notified of material changes via email at least 30 days before they take effect. Continued use of the service after the effective date of any modification constitutes acceptance of the updated terms.
Brobot may also modify service features, underlying infrastructure providers, or included applications at its discretion. We will make reasonable efforts to notify subscribers of changes that materially affect functionality.
